The Future of DACA in a Biden Presidency

On January 20, 2021, Joe Biden will become the 46th president of the United States. Mr. Biden has promised to re-instate the DACA program during his first 100 days in office. As a refresher, here is what DACA is and how to qualify.

Deferred Action for Childhood Arrivals, better known as DACA, grants renewable work authorization and protection from deportation to certain undocumented people who came to the United States as children.

To qualify, applicants must meet the following requirements:

  • Have come to the U.S. before age 16;
  • Be under age 31 as of June 15, 2012;
  • Have continuously resided in the United States since June 15, 2007;
  • Be physically present in the United States on June 15, 2012, and at the time of applying for DACA;
  • Have had no lawful status on June 15, 2012;
  • Be currently in school, have a high school diploma or GED, or be an honorably discharged veteran of the U.S. Coast Guard or Armed Forces; and
  • Have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.

Currently, USCIS is not accepting DACA applications from first-time applicants. However, we are hopeful for the future of the DACA and will continue to provide updates on the state of the program.
