Before you read any further: As of today, there are no changes to the DACA program. If you currently have DACA, you can continue to maintain and renew your status.
However, today, the 5th U.S. Circuit Court of Appeals ruled that the executive order that created the Deferred Action for Childhood Arrivals (DACA) program was unlawful. The Biden administration recently took steps to turn DACA into a federal regulation, rather than an executive order. In light of that new regulation, the appeals court has sent the case back to the lower court in Texas for reconsideration.
While that case is pending, there are no changes to the DACA program as it is now. People who currently have DACA may continue to renew their status, and applications for initial DACA are still on hold.
