As you may recall, in July 2021, a federal judge in Texas issued a ruling that halted the DACA program for new applicants. As of today, we are still waiting for Congress or the federal courts to take action to restore the program. Recently, Congress introduced DACA as a regulation, and it’s currently going through the required notice and comment period, which is a very preliminary stage of trying to make it a law (rather than the executive order that it is now). For now, attorney Inna Scott and the team at GLA continue to monitor the situation closely, and we will update our clients as soon as we have any new information.
As a reminder, the July 2021 ruling only affects people who are applying for DACA for the first time and people applying to renew their DACA status after their previous status was expired for more than one year. The ruling does NOT affect regular DACA renewal applications or applications for Advance Parole based on DACA.
